1. Definitions
- "Agreement" — these Terms & Conditions, together with any engagement letter or service scope document.
- "Services" — pension legal services provided by Rom Yen, including Entitlement Review, Appeal Support, and Full Case Assistance.
- "We / Us / Our" — Rom Yen, a legal services practice located at 90 Sathorn Road, Thung Maha Mek, Bangkok 10120, Thailand.
- "You / Client" — any individual who engages our services or uses our website.
- "Website" — the website operated by Rom Yen at romyen.club.
2. Acceptance of Terms
By contacting us, using our website, or engaging our services, you confirm that you have read and agree to these Terms & Conditions. If you do not agree, please do not use our website or engage our services.
Our services are available to individuals aged 18 years and over who have the legal capacity to enter into a binding agreement. By engaging with us, you confirm that you meet these requirements.
3. Description of Services
Rom Yen provides pension legal advisory and representation services in Thailand. Our three service types are described in detail on our website. Services are provided in English and, where agreed, in Thai.
We operate from our Bangkok office and principally serve clients within Thailand. We do not provide services in jurisdictions outside Thailand.
4. Client Responsibilities
When engaging our services, you agree to:
- Provide complete and accurate information relevant to your matter
- Respond to our communications in a timely manner
- Inform us promptly of any changes to your circumstances that may affect your case
- Use our website only for lawful purposes and in accordance with these Terms
- Not attempt to access our systems without authorisation
5. Intellectual Property
All content on our website — including text, layouts, and visual design — is owned by or licensed to Rom Yen. You may not reproduce, distribute, or use this content for commercial purposes without our prior written consent.
Documents and written summaries we produce for you in the course of providing services are provided for your personal use in connection with your pension matter.
6. Fees and Payment
Our fees are quoted in Thai Baht (THB) and confirmed in writing before work begins. Current starting fees are:
- Entitlement Review — ฿3,500
- Appeal Support — ฿5,600
- Full Case Assistance — ฿7,800 (starting fee; complex matters discussed individually)
Payment is due prior to commencement of work, unless otherwise agreed. We accept bank transfer and cash payment at our office.
Fees paid for work already performed are non-refundable. Where work has not yet commenced following full payment, a refund may be available on request. This does not affect your statutory rights under Thai consumer protection law.
7. Service Delivery and Scope
Each engagement begins with a written scope confirmation setting out what is included and any estimated timeline. We will:
- Carry out the services with reasonable skill and care
- Keep you informed of material developments
- Notify you before undertaking additional work that falls outside the agreed scope
Timelines given are estimates. Delays may arise from third parties (government agencies, pension offices) that are outside our control. We will advise you of any significant delay as soon as it becomes apparent.
8. Confidentiality
We treat all information you share with us as confidential. We will not disclose it to third parties without your consent, except where required by law or by our professional obligations as legal practitioners.
9. Disclaimers
While we provide legal support with care and diligence, we cannot undertake that any particular outcome will be achieved. Pension matters depend on facts, regulatory decisions, and authority processes that are not entirely within our control.
Information on our website is provided for general informational purposes only and does not constitute legal advice in respect of any specific matter.
10. Limitation of Liability
To the extent permitted by Thai law, our total liability to you in respect of any matter shall not exceed the fees paid by you for the relevant service. We are not liable for:
- Indirect or consequential losses
- Delays or failures caused by third parties or government bodies
- Losses arising from incomplete or inaccurate information provided by you
11. Termination
Either party may terminate an engagement by written notice. On termination:
- Fees for work completed up to the date of termination are payable
- We will return your documents and provide a summary of work completed
- Sections of this Agreement that relate to confidentiality, intellectual property, and liability continue to apply after termination
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Thailand. Any dispute arising from our services or these Terms shall be subject to the exclusive jurisdiction of the Thai courts.
We encourage you to raise any concern with us directly in the first instance. We will make every effort to resolve issues promptly and in good faith.
13. General Provisions
- Entire Agreement: These Terms, together with any engagement letter, constitute the entire agreement between us in respect of our services.
- Severability: If any provision is found unenforceable, the remainder of the Terms continue to apply.
- Waiver: Failure to enforce any provision does not constitute a waiver of our right to do so in future.
- Assignment: You may not assign your rights under this Agreement without our prior written consent.
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be published on our website with a revised date. For active engagements, we will notify you of material changes before they take effect.
